Declaración

Atos comunica que el Juzgado de lo Mercantil nº 3 de Madrid ha dictado sentencia el día 19 de octubre de 2022 por la que: (i) declara que las compañías BORNAN SPORTS TECHNOLOGY S.A. y BORNAN SPORTS TECHNOLOGY S.L. han vulnerado los derechos exclusivos de explotación de un software de MSL Technology S.L. (subsidiaria del grupo Atos), y cometido una conducta de competencia desleal consistente en la utilización de un secreto empresarial obtenido de forma ilícita y (ii) condena a ambas entidades al cese en dichas conductas, así como la abstención de reiterarlos en el futuro, así como al pago de una indemnización de daños y perjuicios a MSL TECHNOLOGY S.L. más intereses legales.

La decisión es susceptible de recurso de apelación a la fecha de la presente comunicación.

Atos communicates that the Commercial Tribunal nº3 of Madrid (Juzgado de lo Mercantil nº3 de Madrid) has rendered a sentence on October 19th, 2022: (i) declaring that the companies BORNAN SPORTS TECHNOLOGY S.A. and BORNAN SPORTS TECHNOLOGY S.L. have infringed the exclusive rights of exploitation of a software of MSL Technology S.L (subsidiary of the Atos Group) and carried out unfair competition conduct by using trade secret of Atos obtained illicitly and (ii) requiring these companies to cease such conducts and abstain from repeating them in the future, as well as the payment of damages to MSL Technology S.L increased by legal interests.

This decision is subject to an appeal as at the date of publication of this communication.
